Local Attorneys Asked to Present on Fatigued Truck Driving and Hours of Service Violations
The Florida Justice Association hosted their annual Workhorse Seminar in Orlando on February 25-27. This three-day seminar attracts over 150 Florida attorneys attend to receive hands-on experience and learn from veteran attorneys from across the US. Local personal injury attorneys, Daniel Williams and Steven Calamusa of the law firm Gordon & Doner, were asked to present as expert attorneys on Fatigued Truck Driving and Hours of Service Violations.
“The link between fatigue and safety is much more immediate and devastating in the trucking and transport industry than in other industry” said Mr. Williams. According to the National Highway Traffic Safety Administration, one of every eight traffic fatalities is caused by a collision with a large truck, and most deaths that occur in these accidents are the passengers of the automobiles.
“Many trucking companies place unrealistic goals upon their drivers, requiring them to drive too many miles in too short a time period. The reason: they care more about profits than safety. This unfortunate philosophy leads to fatigued drivers and tragic crashes,” said Mr. Calamusa.
One study shows that 56% of truck drivers tested presented a total of at least six (non-continuous) minutes of EEG-recorded sleep during one driving session. In addition, another study shows that in a typical driving session a truck driver will have eight inappropriate line crossings after eight hours of sleep, and 65 inappropriate line crossings after decreased sleep.
